The Law of Agency

Live Instructor-Led The Law of Agency

Aims

This course aims to explain the law of Agency and how it deals with the appointment and authority of agents, sub-agents, and the revocation of authority. It will also cover the agent’s duty towards the principal and the principal’s duty towards the agent. The course will cover the role of the agency in contracts with third parties. The course will enable those in commercial, procurement and contracting to understand the Agency Law related contracting and procurement and will reduce the pressure upon in-house legal counsel and therefore prevent delays.

Target Audience

This “Live” instructor-led course is for those who have a fiduciary relationship with the Agent or the Principal, created by express or implied contract and who are responsible for the formation and management of Agency agreements, from both the Agent and the Principals’ perspectives.

Learning Outcomes

By the end of the course, participants will be able to:

  • Differentiate between each party in the agency process: the agent, the principal and the client and the duties placed on each
  • Explain the fiduciary duty of agents and how agents can act on behalf of the principal
  • Identify how the law of agency applies in practice and what happens when the agreement is terminated
  • Define the fiduciary duty placed on agents
  • Explain the agent and client relationship and the legal duties of each party
  • Explain the implications when an agent acts without explicit instruction from the principal
  • Describe how an agent may ‘bind’ the principal to a contract
  • Explain how the principal or the agent can terminate services
  • Explain the agents and principals (internal relationship), known as the principal-agent relationship
  • Agents and the third parties with whom they deal on their principals’ behalf (external relationship)
  • Explain the principals and the third parties when the agents deal directly
